SMART CDL ACADEMY – TERMS AND CONDITIONS

These terms and conditions outline the rules and regulations for the use of Smart CDL Academy's website and services.

By accessing and using the Smart CDL Academy website and enrolling in our services, you accept these terms and conditions in full. If you disagree with any part of these terms and conditions, you must not use our website or services.

Definitions

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements:

  • "Student", "You" and "Your" refers to you, the person enrolling in CDL training programs, accessing our website, and accepting Smart CDL Academy's terms and conditions.
  • "The Academy", "Company", "Ourselves", "We", "Our" and "Us" refers to Smart CDL Academy.
  • "Party", "Parties", or "Us" refers to both the Student and ourselves, or either the Student or ourselves.
  • "Intellectual Property" means all intellectual property rights of whatsoever nature, including (without limitation) patents, designs, present and future trademark or copyright, and whether or not registered or registrable by any means.
  • "Services" means CDL training programs, courses, testing services, and any other educational or training services provided by Smart CDL Academy.
  • "CDL" refers to Commercial Driver's License.

All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our training and educational assistance to the Student in the most appropriate manner, in accordance with and subject to prevailing Texas state law and federal regulations.

Enrollment and Training Services

Eligibility Requirements

By enrolling in our CDL training programs, you confirm that you:

  • Are at least 18 years of age (21 for interstate driving)
  • Possess a valid driver's license
  • Can pass the Department of Transportation (DOT) physical examination
  • Meet all federal and state requirements for CDL eligibility
  • Have provided accurate and truthful information on all enrollment documents

Training Program Terms

  • All tuition and fees must be paid according to the agreed payment schedule
  • Students must maintain satisfactory attendance and progress as defined by the Academy
  • Students must comply with all Academy rules, regulations, and safety requirements
  • The Academy reserves the right to dismiss students for violation of policies, unsafe behavior, or academic dishonesty
  • Training schedules are subject to change due to weather, equipment availability, or instructor availability

Testing Services

As an official Texas DPS Third Party Skills Test Provider (TPST #0221):

  • Testing fees are separate from training fees unless otherwise specified
  • Students must meet all prerequisites before scheduling skills tests
  • Test results are final and subject to Texas DPS regulations
  • The Academy maintains the right to refuse testing services if safety or eligibility requirements are not met

License and Intellectual Property

Unless otherwise stated, Smart CDL Academy and/or its licensors own the intellectual property rights for all material on www.smartcdlacademy.com and all training materials provided. All intellectual property rights are reserved. You may view and/or print pages from our website for your own personal use subject to restrictions set in these terms and conditions.

You must not:

  • Republish material from Smart CDL Academy without written permission
  • Sell, rent, or sub-license material from Smart CDL Academy
  • Reproduce, duplicate, or copy training materials or curriculum
  • Redistribute content from Smart CDL Academy (unless content is specifically made for redistribution)
  • Use our materials to establish competing CDL training programs
  • Record, photograph, or video training sessions without express written permission

Payment Terms

All fees are due according to the payment schedule agreed upon at enrollment

Payment plans may be available and are subject to approval

Refunds are subject to our refund policy as outlined in your enrollment agreement

The Academy reserves the right to withhold certificates, transcripts, or testing services for unpaid balances

Additional fees may apply for re-testing, additional training hours, or certificate replacements

Student Conduct and Safety

Students must:

  • Follow all safety protocols and procedures during training
  • Maintain a drug and alcohol-free status as required by DOT regulations
  • Treat instructors, staff, and fellow students with respect
  • Report any accidents, injuries, or safety concerns immediately
  • Maintain appropriate dress code and personal hygiene standards
  • Comply with all federal and state regulations regarding CDL training

Reservation of Rights

We reserve the right at any time and in our sole discretion to:

  • Modify or discontinue any training program or service
  • Change pricing, schedules, or curriculum
  • Request that you remove all links or any particular link to our website
  • Amend these terms and conditions and any policies at any time

By continuing to use our website and services, you agree to be bound by and abide by these terms and conditions.

Liability and Disclaimer

Training Disclaimer

CDL training involves the operation of large commercial vehicles and inherently carries risks. By enrolling in our programs, you acknowledge and accept these risks. Smart CDL Academy, its instructors, and staff will not be liable for:

  • Accidents or injuries that occur due to student negligence or failure to follow safety instructions
  • Loss of employment opportunities or income
  • Failure to pass CDL examinations despite completing training
  • Changes in CDL regulations or requirements

General Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties, and conditions relating to Smart CDL Academy and the use of this website.

Nothing in this disclaimer will:

  • • Limit or exclude our or your liability for death or personal injury resulting from negligence
  • • Limit or exclude our or your liability for fraud or fraudulent misrepresentation
  • • Limit any of our or your liabilities in any way that is not permitted under applicable law
  • • Exclude any of our or your liabilities that may not be excluded under applicable law

Events Outside of Our Control

We will not be liable or responsible for any failure to perform, or delay in performance of any of our obligations under any contract with you that is caused by events outside of our reasonable control (a "Force Majeure Event") including, without limitation:

Natural disasters (fire, flood, earthquake, storm)

War, terrorism, sabotage, revolution, riot, or civil commotion

Government actions, regulations, or restrictions

Strikes, lockouts, or labor disputes

Failure of utilities or telecommunications networks

Pandemic or epidemic-related restrictions

Our performance under our contract with you is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which our obligations under such contract may be performed despite the Force Majeure Event.

Privacy and Data Protection

Your use of our website and services is also governed by our Privacy Policy. By using our services, you consent to the collection and use of information as outlined in our Privacy Policy.

Dispute Resolution

Any disputes arising from these terms and conditions or your use of our services shall be first attempted to be resolved through good faith negotiation, subject to mediation if negotiation fails, and governed by the laws of the State of Texas.

Severability

If any provision of these terms and conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Without prior approval and express written permission, you may not create frames around our web pages or use other techniques that alter in any way the visual presentation or appearance of our website.
